These Terms of Service ("Terms") govern your use of the EmailAI.me website and related services (collectively, the "Service") operated by ATN Marketing SRL ("we," "us," or "our"), a company registered in Romania. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

EmailAI.me provides free AI-powered email writing tools that generate email drafts based on user-provided text prompts. The Service includes, but is not limited to, the AI email generator, email reply generator, cold email generator, subject line generator, email proofreader, and all other tools available on the site. The Service generates text output only. It does not send emails, access your inbox, or interact with any email service on your behalf.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:

• Generate content that is illegal, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Create spam, phishing emails, or any content designed to deceive, defraud, or manipulate recipients.
• Generate content that infringes upon the intellectual property rights, privacy rights, or other rights of any third party.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Interfere with or disrupt the Service, its servers, or networks connected to the Service.
• Attempt to circumvent rate limits, security measures, or access controls through automated means, scripting, or any other method.
• Use the Service to develop competing products or services, or to reverse-engineer the underlying technology.
• Transmit viruses, malware, or any other harmful code through the Service.

We reserve the right to suspend or block access to the Service for any user who violates these acceptable use provisions, without prior notice.

4. AI-Generated Content Disclaimer

All content generated by the Service is produced by an artificial intelligence model and is provided "as is" without any warranty of accuracy, completeness, appropriateness, or fitness for any particular purpose.

You acknowledge and agree that:

• AI-generated email drafts may contain factual errors, inappropriate tone, grammatical imperfections, or content that does not accurately reflect your intent.
• The AI does not verify names, dates, figures, claims, or any factual information included in the output. If your prompt contains errors, the generated content will reproduce them.
• The AI does not understand your relationship with the recipient, organizational communication norms, or the specific context of your situation beyond what you provide in the prompt.
• Generated content does not constitute professional advice of any kind, including legal, financial, medical, or HR advice.
• You are solely responsible for reviewing, editing, and approving all generated content before sending or using it in any capacity.

Do not rely on AI-generated drafts as final text for legal correspondence, employment actions, regulatory filings, contractual obligations, or any communication with potential legal consequences without appropriate professional review.

5. Rate Limits and Service Availability

The free Service is subject to a daily generation limit per user. This limit exists to ensure fair access for all users and to manage infrastructure costs. The current limit is displayed when reached. We reserve the right to modify rate limits at any time without prior notice.

We do not guarantee that the Service will be available at all times or without interruption. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We are not liable for any damages resulting from Service unavailability.

6. Intellectual Property

6.1 Your Content

You retain ownership of the text you submit as prompts to the Service. You also retain ownership of the AI-generated output produced from your prompts. We do not claim any intellectual property rights over content you create using the Service. You are free to use, modify, distribute, or publish any generated content without restriction or attribution.

6.2 Our Content

The EmailAI.me website, including its design, layout, graphics, logos, text content (excluding user-generated output), and underlying code, is the property of ATN Marketing SRL and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our website content without our prior written consent.

6.3 Trademarks

"EmailAI," "Fly Email," and associated logos are trademarks of ATN Marketing SRL. You may not use these marks without our prior written permission, except to accurately refer to our Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we handle data, what information we collect, and how we protect your privacy. Email content submitted to our tools is not stored or retained. Please review the Privacy Policy for complete information.

8. Third-Party Services

The Service uses the OpenAI API to process email generation requests. Your use of the Service is subject to OpenAI's terms and policies insofar as they apply to data processed through their API. We are not responsible for the practices, availability, or performance of third-party services. Links to external websites (including app store listings) are provided for convenience and do not imply endorsement.

9. Fly Email Mobile App

The Fly Email mobile app for iOS and Android is subject to its own terms of service and the terms of the respective app stores (Apple App Store, Google Play). In-app purchases and subscriptions are governed by Apple's and Google's policies. We do not process payments directly.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• ATN Marketing SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• ATN Marketing SRL shall not be liable for any damages arising from the content generated by the AI, including but not limited to damages caused by errors, omissions, inappropriate content, or reliance on generated text.
• Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve months preceding the claim (which, for free web users, is zero).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless ATN Marketing SRL, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We also reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and without prior notice. Since the Service does not require an account, termination may be implemented through IP-based or other technical restrictions. The provisions of these Terms that by their nature should survive termination (including Sections 4, 6, 10, 11, and 14) will continue to apply after termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romania. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
